Terms of Service

Welcome to Foodplan. These Terms of Service ("Terms") govern your access to and use of the Foodplan mobile and web application and related services (together, the "Service"), operated by Foodplan ("Foodplan", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use Foodplan

You must be at least 16 years old to create an account. If you are creating a household account on behalf of family members, you confirm that you are authorized to do so and that you are responsible for the activity of any member you invite.

2. Your account

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must provide accurate information when creating your account and keep it up to date.
  • You must notify us promptly if you become aware of any unauthorized use of your account.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

3. Households and shared data

Foodplan is designed around a shared household: weekly menus, recipes, products and shopping lists you create may be visible to and editable by other members of your household account. Personal nutrition tracking (what you individually eat and log) is private to you within the household, as described in our Privacy Policy. You are responsible for deciding who you invite into your household and understanding what they will be able to see.

4. Nutrition and health information

Foodplan lets you log meals, portions and estimated calorie intake. This information is provided for general planning and self-tracking purposes only. Foodplan is not a medical device and does not provide medical, nutritional, or dietary advice. Nutrition values shown in the app are estimates based on recipe and product data, which may be incomplete or inaccurate. Always consult a qualified healthcare professional or registered dietitian before making decisions about your diet, especially if you have a medical condition, allergy, or are pregnant or breastfeeding.

5. Acceptable use

When using Foodplan, you agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Upload content that is offensive, infringing, or that you do not have the right to share;
  • Attempt to gain unauthorized access to other accounts, the Service's infrastructure, or data;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law;
  • Use automated means (bots, scrapers) to access the Service without our prior written consent.

6. Your content

You retain ownership of the recipes, notes, and other content you add to Foodplan ("Your Content"). By submitting Your Content, you grant Foodplan a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content for the purpose of operating and improving the Service, including for you and your household and, where you choose to share it as described below, for the recipients of that sharing. We do not claim ownership of Your Content and will not sell it to third parties.

Foodplan may let you publish a recipe beyond your own household, either privately (shared only with specific people you choose) or publicly (visible to other Foodplan users or, where indicated, the general public). You are solely responsible for Your Content that you choose to share in this way and confirm that you have the right to share it. Content you publish publicly may be viewed, and where the feature allows it, copied or added to another user's own household by anyone with access, even after you later change its visibility or delete it from your account, to the extent it has already been copied or cached. You can change a recipe's visibility or remove it from public or shared view at any time from within the app; this does not affect copies other users already made before you did so.

7. Subscriptions and payment

Certain features of Foodplan may be offered as a paid subscription. Where applicable, pricing, billing frequency, and cancellation terms will be presented to you at the time of purchase through the relevant app store or payment provider. Subscriptions renew automatically unless cancelled before the end of the current billing period, in accordance with the policies of the app store through which you subscribed (Apple App Store or Google Play). Fees are non-refundable except where required by law.

8. Intellectual property

The Service, including its design, logos, trademarks, software, and underlying technology, is owned by Foodplan and protected by intellectual property laws. These Terms do not grant you any right to use Foodplan's branding except as necessary to use the Service as intended.

9. Third-party services

Foodplan may rely on third-party infrastructure and services (such as cloud hosting, authentication, and analytics providers) to operate. We are not responsible for the availability or content of any third-party services we do not control.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that nutrition data will be complete or accurate.

11. Limitation of liability

To the maximum extent permitted by law, Foodplan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

12. Termination

You may stop using the Service and delete your account at any time from within the app or by contacting us. We may suspend or terminate your access to the Service if you breach these Terms, with notice where reasonably possible. Upon termination, your right to use the Service ceases immediately; provisions that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service or for legal, regulatory, or operational reasons. If we make material changes, we will notify you through the app or by email before they take effect. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of the Netherlands, unless mandatory consumer protection law in your country of residence provides otherwise.
